What is commercial property?

Commercial property is real estate used for business purposes and activities. This can include buildings, land and residential rental properties that either house the business or generate profit.

What is a commercial lease?

A commercial lease is a legally binding contract between a Landlord and a Tenant. This gives the tenant the right to the building for business or other commercial activities, for a set period of time and for payment of a rent. 

Types of commercial leases in the UK 

When opting for a commercial property lease agreement it’s important to choose the right one for your business's circumstances. There are lots of different options available so get in touch if you need assistance. Here are a few examples of commercial leasing in England:

  • FRI Lease- This is a fully insuring and repairing lease. All costs of repair and insurance are bourne by the Tenant. This means that the Tenant is responisble for repairs even if they didn’t put the property into disrepair. 
  • Eggshell/ internal only Lease - This is a lease whereby the Tenant is responsible for repairing the internal elements of the property only. The structural elements of the property are not the Tenant’s responsibility to repair. The Tenant will also be responsible for paying a proportionate part of any insurance costs.  
  • Tenancy at Will - This is not a lease and is simply a right to use a property which can be terminated at will by either the Landlord or the Tenant. 
  • Licence to Occupy - This is not a lease and is a licence to use the Property. The rights that a Tenant has under this type of document are very limited.
